Terms of Service (Draft)

These draft terms describe the intended arrangement for using Crescendo IQ, a software service that music-education programs use to manage their students. They are provided for planning and are not yet binding.

1. The service

Crescendo IQ lets music-education programs — private instructors, school band/choir/orchestra directors, and music studios — create student rosters and groups, configure profile fields, track practice and attendance, record assessments, and send transactional and optional parent-verification emails. Features may change over time.

2. Accounts and eligibility

Users are responsible for the accuracy of their account information and for keeping their credentials secure. Programs are responsible for the accounts they create or invite within their organization, and for ensuring they have the authority to enroll the students and collect the information they choose to collect.

3. Acceptable use

Users agree to use the service only for its intended educational purpose and in compliance with applicable law. Users agree not to attempt to access data belonging to other organizations, to disrupt the service, or to misuse secure links.

4. Student data and privacy

Personal information is handled as described in the Privacy Policy (also a draft pending review). Programs that use Crescendo IQ with K-12 students are responsible for providing any notices and obtaining any consents that the law requires, and the service is designed to support a consent step before a child's information is collected. Programs can export and delete student data, and Crescendo IQ will delete student data at a program's request.

5. Subscriptions and billing

Paid plans are billed through our payments provider on the terms presented at sign-up. Billing information belongs to the paying organization; students' information is not used for billing.

6. Availability and changes

We aim to keep the service available and reliable, but it is provided on an "as is" basis during this draft stage, without warranties. We may update, add, or remove features.

7. Termination

A program may stop using the service at any time. On termination, student data is handled as described in the Privacy Policy and may be deleted at the program's request.

8. Limitations

The final terms will include the limitation-of-liability, indemnification, dispute-resolution, and governing-law provisions appropriate for the service. Those provisions are pending legal review and are intentionally not stated here.

9. Changes to these terms

This is a draft and will change. Once approved, the effective version and its date will be published here.
