Version 2026-07-07. This document is in effect as of its version date. We review our legal documents with counsel as part of our process, and we announce material changes to affected users.
These terms are an agreement between you and Crescendo-IQ LLC("Crescendo-IQ", "we") for using the Crescendo-IQ service. By creating an account or using the service you agree to them.
1. The service
Crescendo-IQ lets music-education programs (school band, choir, and orchestra directors, private instructors, and music studios) manage rosters and groups, track practice and attendance, run skill ladders and reviews, coach students, and run optional motivation features. Every optional feature is controlled by the program: modules are off until a director turns them on. Features may change over time.
2. Accounts and roles
Programs are operated by directors and instructors; students participate through accounts their program enrolls or invites. You are responsible for the accuracy of your account information and for keeping your credentials secure. Programs are responsible for the accounts they create or invite and for having the authority to enroll their students and collect the information they choose to collect, including any notices or consents the law requires.
3. Acceptable use
Use the service only for its educational purpose and in compliance with applicable law. Do not attempt to access another organization's data, disrupt the service, probe its security, misuse secure links or codes, or use the service to harass anyone. Student-to-student messages in the service are limited by design to templated, positive interactions; do not attempt to work around those limits.
4. Student data
Personal information is handled as described in the Privacy Policy. Student data belongs to the student and their program: programs can export it and can have it deleted, and our erasure machinery removes a student's history on request. For school programs, the Data Processing Agreement governs our role. We never sell personal information and never use it for advertising.
5. Media
Crescendo-IQ never hosts student audio or video. Where the service works with recordings, students record on their own devices and share links (for example an unlisted YouTube or Google Drive link) that their program reviews. Those platforms' own terms apply to content stored there, and students keep control of their own files.
6. Points, awards, and the store
Points, streaks, divisions, badges, and similar features measure effort and growth. They are not money, have no cash value, cannot be transferred or redeemed outside the service, and can be adjusted by the program or by us to correct errors or abuse. Store rewards are defined and fulfilled by the program, not by Crescendo-IQ.
7. Subscriptions and billing
Paid plans are billed through our payments provider on the terms presented at purchase. Billing belongs to the paying organization; students' information is never used for billing.
8. Availability, warranties, and liability
We work to keep the service available and reliable, but the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent the law allows: neither party is liable for indirect, incidental, special, consequential, or punitive damages; and our total liability for all claims arising out of the service is limited to the amounts the claiming organization paid us in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.
9. Disputes
These terms are governed by the law of the State of Illinois, without regard to its conflict-of-law rules. Disputes will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court. Class actions and class arbitrations are waived to the extent the law allows.
10. Termination
A program may stop using the service at any time. We may suspend or end access for material violations of these terms after reasonable notice where practical. On termination, student data is handled as the Privacy Policy and the DPA describe, including deletion at the program's request.
11. Changes to these terms
When these terms change, the new version and its date are published here, and material changes are announced to affected users before they take effect.
